WERTH: It’s hard to say. Actually, we just don’t know. But whatever their incentive might be, their FOIA requests have produced what look like some pretty damning e-mails between CCRF — which, again, receives funding from payday lenders — and academic researchers who have written about payday lending.
It may not even surprise you to learn that the Center for Responsible Lending — the non-profit that’s fighting predatory lending — that it was founded by a credit union, the Self-Help Credit Union, which would likely stand to benefit from the elimination of payday loans. And that among the Center’s many funders are banks and other mainstream financial institutions.

But some economists see them as a useful financial instrument for people who need them. As the Consumer Financial Protection Bureau promotes new regulation, we ask: who’s right?

Payday lenders do not compare their interest rates to those of mainstream lenders. Instead, they compare their fees to the overdraft, late payment, penalty fees and other fees that will be incurred if the customer is unable to secure any credit whatsoever.
However, despite the tendency to characterize payday loan default rates as high, several researchers have noted that this is an artifact of the normal short term of the payday product, and that during the term of loans with longer periods there are frequently points where the borrower is in default and then becomes current again. Actual charge offs are no more frequent than with traditional forms of credit, as the majority of payday loans are rolled over into new loans repeatedly without any payment applied to the original principal.

This reinforces the findings of the U.S. Federal Deposit Insurance Corporation (FDIC) study from 2011 which found black and Hispanic families, recent immigrants, and single parents were more likely to use payday loans. In addition, their reasons for using these products were not as suggested by the payday industry for one time expenses, but to meet normal recurring obligations.
On the other hand, if you are considering taking out a payday loan, be sure to exhaust all other remedies available before moving forward. Payday loans are often accompanied by excessive finance charges and fees, which can get you deeper in debt if you repeatedly use them to bail out when financial emergencies arise.
If your bank (the “paying bank”) returns a debit entry to your bank account, then you must pay an additional returned item fee of $15. We charge you only one returned item fee per deferred deposit transaction no matter how many times the paying bank returns an item.
Be aware that not all banks and credit unions accept same day wire transmissions and your bank may charge a fee in addition to any wire fee. Note: bank wires can only be done during normal banking hours Monday through Friday, excluding bank holidays and when banks post most wire transactions. The rule would also target longer-term loans with a 36 percent yearly interest rate or higher, restricting lenders from directly extracting money from the consumer’s account, without the borrower’s explicit consent, if they failed to repay twice in a row. Any direct withdrawal from a consumer’s account would also require standard prior notification. The commonsense rule was projected to reduce the industry’s yearly revenue by two-thirds.
Last year the Consumer Financial Protection Bureau (CFPB) crafted a long-awaited rule on payday lending—the industry offering short-term loans that exploit poor consumers—to clamp down on fraud by forcing lenders to “reasonably determine that the consumer has the ability to repay the loan” (rather than defaulting or submitting to even more exploitative terms). The rule, spearheaded by the Obama administration and widely supported by consumer and public-interest groups, allowed exemptions for smaller-scale loans by requiring lenders to follow certain consumer-protection provisions rather than go through the “ability-to-pay” determination.
“For the many people that struggle to repay their payday loans every year this is a giant leap forward. From January next year, if you borrow £100 for 30 days and pay back on time, you will not pay more than £24 in fees and charges and someone taking the same loan for fourteen days will pay no more than £11.20. That’s a significant saving.

Don’t hide from bad news. Don’t ignore a lawsuit summons or other notices from a court or the lender, or any court proceedings against you. If you ignore a lawsuit, you may lose the opportunity to fight a wage or bank garnishment.
Does a researcher who’s out to make a splash with some sexy finding necessarily operate with more bias than a researcher who’s operating out of pure intellectual curiosity? I don’t think that’s necessarily so. Like life itself, academic research is a case-by-case scenario.
Credit.com’s journalism is largely supported by an e-commerce business model. The CFPB has issued several enforcement actions against payday lenders for reasons such as violating the prohibition on lending to military members and aggressive collection tactics. The CFPB also operates a website to answer questions about payday lending. In addition, some states have aggressively pursued lenders they felt violate their state laws.

This compensation may influence the selection, appearance, and order of appearance of the offers listed on the website. However, this compensation also facilitates the provision by Credit.com of certain services to you at no charge. The website does not include all financial services companies or all of their available product and service offerings.
And yet it is surprisingly difficult to condemn the business wholesale. Emergency credit can be a lifeline, after all. And while stories about the payday-lending industry’s individual victims are horrible, the research on its effect at a more macro level is limited and highly ambiguous. One study shows that payday lending makes local communities more resilient; another says it increases personal bankruptcies; and so on.
DUBNER: Wowzer. That does sound pretty damning — that the head of a research group funded by payday lenders is essentially ghostwriting parts of an academic paper that happens to reach pro-payday lending conclusions. Were you able to speak with Marc Fusaro, the author of the paper?
