Fringe financial services is the label sometimes applied to payday lending and its close cousins, like installment lending and auto-title lending—services that provide quick cash to credit-strapped borrowers. It’s a euphemism, sure, but one that seems to aptly convey the dubiousness of the activity and the location of the customer outside the mainstream of American life.
A small percentage of payday lenders have, in the past, threatened delinquent borrowers with criminal prosecution for check fraud.[33] This practice is illegal in many jurisdictions and has been denounced by the Community Financial Services Association of America, the industry’s trade association.
Ivy Brodsky, 37, thought she had figured out a way to stop six payday lenders from taking money from her account when she visited her Chase branch in Brighton Beach in Brooklyn in March to close it. But Chase kept the account open and between April and May, the six Internet lenders tried to withdraw money from Ms. Brodsky’s account 55 times, according to bank records reviewed by The New York Times. Chase charged her $1,523 in fees — a combination of 44 insufficient fund fees, extended overdraft fees and service fees.
When Britain threw out 23 Russian diplomats in response to an assassination attempt on Russian agent Sergei Skripal, Vladimir Putin, the president of Russia and current bad boy of modern geopolitics, shrugged it off. With relations between London and Moscow so strained, the embassy didn’t have all that much to do, anyway. The cost, Putin no doubt felt, was predictable and bearable. Then on Monday, 20 additional countries, from Albania to Ukraine, joined in a coordinated expulsion campaign, with the United States accounting for 60 of the Russians sent packing. On Tuesday, NATO announced it would expel seven Russian diplomats in response to the poisoning. Suddenly, the Kremlin isn’t looking quite so comfortable. With the Skripal hit, it looks as if Putin may have finally overreached.
The banking industry says it is simply serving customers who have authorized the lenders to withdraw money from their accounts. “The industry is not in a position to monitor customer accounts to see where their payments are going,” said Virginia O’Neill, senior counsel with the American Bankers Association.
In the traditional retail model, borrowers visit a payday lending store and secure a small cash loan, with payment due in full at the borrower’s next paycheck. She said she applied for a $400 loan from Loanshoponline.com and a $700 loan from Advancemetoday.com in 2011. The loans, with annual interest rates of 730 percent and 584 percent respectively, skirt New York law.

And without academic research, the regulation is going to be based on who shouts the loudest. And that’s a really bad way to write law or regulation. That’s what I really worry about. If I could advocate a solution to this, it would be: identify the number of rollovers at which it’s been revealed that the borrower is in trouble and is being irresponsible and this is the wrong product for them. At that point the payday lender doesn’t flip the borrower into another loan, doesn’t encourage the borrower to find another payday lender. At that point the lender’s principal is then switched over into a different product, a longer term loan where he or she pays it off a little bit each month.
